What were the arguments for and against the Indian Removal Act?

Answers

Answer: The for is by pushing the Natives outside the country's boundaries, Natives would be able to return to the culture they once knew and would be able to throw away the white culture they were forced to absorb. This would allow the Indian heritage to live on. one argument made against the act was that the act went against what the foundation of America was built off of: the Constitution. Treaties formally signed with the Natives regarding their right to possess their own land were neglected.

Freedom of speech is a fundamental American right, but limits on American freedom of speech also exist. Throughout American history, the Supreme Court has ruled on the types of speech and other forms of expression that are and are not protected by the First Amendment of the United States Constitution.

The First Amendment

Even though the First Amendment of the United States Constitution protects the rights of Americans to express themselves, there are limits on this freedom. The Constitution states that the government cannot make any law that restricts free speech or freedom of the press. This means that the government cannot censor what Americans read in newspapers or other forms of media and the government cannot arrest citizens for speaking about their ideas and opinions, even if they differ from those of the government. However, this does not mean that Americans are free to say whatever they want at any time they want to say it. There are situations where some types of speech is illegal.

Defamation: Hurting another Person’s Reputation

Freedom of speech does not permit someone to make a false statement about another person that could damage his or her reputation. This applies to the spoken word, which is called slander, as well as libel, which is defamation in print. Making these false statements must also be done with the intent to harm another. In one of the most important libel cases in the U.S., a police commissioner in Montgomery, Alabama, L.B. Sullivan sued the “New York Times” for making inaccurate statements about the police department. The Supreme Court ruled that the newspaper did not commit libel because the statements were a mistake, not intentional, and that it could be more difficult to debate public issues if those who work in the public can sue anytime a false statement is made.

Clear and Present Danger

Americans are not free to make false statements that could cause panic or place others in danger. Justice Oliver Wendell Holmes wrote in 1919, in the Supreme Court’s ruling in Schenck versus the United States, that there are times, particularly in times of war, when the government must restrict speech to protect the safety of the country and its citizens. In this case, the court unanimously ruled that Charles Schenck and Elizabeth Baer did not have the right to distribute leaflets encouraging Americans to avoid the draft. It is within this ruling that Holmes wrote his often-quoted phrase about the First Amendment not protecting “a man in falsely shouting fire in a theatre and causing panic.” Creating a clear and present danger is not a form of speech protected by the First Amendment.

Obscenity

In 1973 in Miller vs. California, the Supreme Court ruled 5 - 4 that the First Amendment does not protect obscenity. Defining obscenity can be difficult and the court did state that obscene is not necessarily the same as indecent, which is material intended for adults, not children. The Supreme Court also noted that caution has to be used in limiting personal expression, particularly when determining what is obscene and what is not. However, the court ruled that if the average person would find the speech or expression obscene and if it cannot be considered art, it is not protected by the Constitution.

We are fortunate to live in a place where we are free to express ourselves, within limits. These limitations do not take away from the meaning of the First Amendment. The right to free speech is a fundamental American right and a big part of why Americans cherish their freedom

Explain the difference between courts of original jurisdiction, appellate courts, and courts of last resort, often called supreme court.

Answers

Answer:

In common law legal systems original jurisdiction of a court is the power to hear a case for the first time, as opposed to appellate jurisdiction, when a higher court has the power to review a lower court's decision. Here, then, is the primary distinction between trial and appellate courts: Whereas trial courts resolve both factual and legal disputes, appellate courts only review claims that a trial judge or jury made a legal mistake. A court of last resort is the highest judicial body within a jurisdiction's court system. It is a court with the highest appellate authority, meaning that its rulings are not subject to further review by another court. A court of last resort is often, but not always, referred to as a supreme court.

Abraham Lincoln, the 16th president of the United States, was born on February 12, 1809 and died at the age of 56 on the 4th day of March 1861. Lincoln was the president of the United States for four years from 1861 to 1865. Lincoln was born in Hardin County in the state of Kentucky in a small cabin that only had one room. His parents, Thomas Lincoln and Nancy Hanks were farmers who had a large tract of land that measured 348 acres on which their cabin was situated. His parents were uneducated, however. Lincoln’s political career began in 1832 when he created a political campaign for a political party known as the Whig Party. This party was based on efforts that sought to improve navigation on the neighboring river. Ten years later, Lincoln married the love of his life, Mary Todd, with whom he had four sons. Unfortunately, only one of his four sons did not survive into adulthood. Lincoln’s participation in active national politics took a turn for the better in 1842 when he campaigned and was elected to the US House of Representatives. While at the House of Representatives, Lincoln accomplished a number of things including accrediting the American-Mexican war to then president, Polk. Lincoln was, however, not a popular figure with the democrats, due to his speeches that tended to go against the beliefs of the Democratic Party. In 1960, Lincoln’s political star had grown so much such that he was nominated by the Republican Party to become their presidential candidate. His temperate views on the issues of western origin and slavery are said to have significantly contributed to his preference as a Republican candidate. Throughout the election period, Lincoln did not give any speeches but instead gave the Republican organization charge of any speeches that were required. On the 6th day of November 1860, Lincoln assumed the highest office in the US when he was elected to the office of the president of the land. It was during Lincoln’s presidency that the Civil War began. This war began in the year 1861 and ended up consuming a large portion of Lincoln’s time as the president of America. Biographies of Lincoln report that Lincoln often found himself very frustrated by the events that were taking place in the war. The war eventually ended on the 9th day of April 1865 when Robert Lee decided to surrender in Virginia. The 14th day of April, 1865 is a popular day in Lincoln’s presidency because this is the day when, inside the Ford’s theater, Lincoln had gone to watch a play without his bodyguard who apparently had knowledge of the president’s planned assassination. It was while Lincoln watched the funniest part of the play, while seated on the balcony, that he was shot point blank in the head by John Wilkes Booth who had hoped that the noise from the cheers and laughter would swallow up the noise of the gunshot. Booth was captured, however, and the president passed away a few hours later.

Having aligned themselves with the Republican Party since the days of Abraham Lincoln, what made African Americans switch to the Democrats during the Depression Era? This lesson explores why African Americans voted for Franklin Roosevelt, despite the fact that the Democratic Party had traditionally denied them basic civil rights. Using primary sources and a variety of voices from the period, students can discover how the Depression affected African- American workers, and why black voters switched their allegiance during the period. Students will also learn how Democrats and Republicans of the time responded to the call for civil rights. Roosevelt’s problem was that in order to retain his position of leadership, he had to keep the Southern Democrats – who time and again denied African Americans the vote in their states – within the party. Although Roosevelt made no move to reverse the legal segregation at the time, he did invite several African-American leaders to serve as advisors to the administration. He also ensured that African Americans had access to relief during the worst days of the Depression. Because of Roosevelt’s willingness to engage African Americans as Americans, he won their votes for the Democratic Party for decades to come.

B) Women have lost civil rights that they once enjoyed because of prejudice

C) The Constitution has been amended to forbid unequal treatment of the sexes.

Answers

Answer:I would say D

Explanation: many women still aren’t protected but if we’re talking about the US then C

As a result of constitutional amendments banning gender inequality, American women's understanding of equality has evolved over time. As a result, choice (C) is the correct response.

What rights do women have in America?

In order to achieve gender equality, women and men must be able to benefit equally from the opportunities, resources, incentives, and other socially valued items.

In contrast to other nations, the legal status of women in the United States is the same as that of men, and generally speaking, women are also thought to have an equal social standing to men.

In the US, women have the right to be educated, to own property, to vote, to be free from abuse and discrimination, to enjoy the best achievable standard of physical and mental health, and to be paid equally to males.

Hence, Option (C ) is the correct choice.

Answers

Answer:

Responses may vary but should include some or all of the following information:  Prior to the labor rights set by the progressive movement, there were many issues with child labor, unsafe working conditions, and long hours. The provisions that were set up alleviated many of these issues. The work day was shortened to eight hours in mines and other public work projects. Children under the age of 15 were not allowed to work in hazardous areas. No girls were allowed to work in underground mines and neither were boys under the age of 16. Also, the chief mine inspector had to have at least eight years of experience working in mines. Finally, convict labor was prohibited throughout the state, and the Department of Labor was established.
